This webpage and blog provides freedom of information to Crofton, Maryland Charing Cross Townhouse Association homeowners who cannot get information on the pending lawsuit against the Association, its directors and property manager.

LAWSUIT SUMMARY – Original Complaint

The facts underlying the lawsuit are well documented. They happened. That the activities portrayed in the facts violate our governing laws speak plainly enough to me…although, one must always allow for a clever defense. Take a look…see what you think.

This lawsuit is to compel Defendants to obey our governing laws. So, what are they defending? That they already are? Let the facts speak for themselves. Then ask, why have they already spent our Association into the RED defending a lawsuit that only seeks to compel them to follow our governing laws?

The lawsuit alleges that the Defendants in this case have sought to rule without limits and unencumbered by our governing laws. In so doing they create disorder, chaos and confusion among homeowners…in short, bad governance. What the lawsuit seeks to accomplish (which Plaintiff couldn’t accomplish as vice president of the Association prior to the lawsuit) is for the Association and its property manager to acknowledge and abide by the limits of the powers conveyed upon them; to abide by the process and rules and laws that govern the condominium association, and thereby ensure order and fairness to the homeowners who are the owners of the condominium…in short, good governance. 

The lawsuit currently complains of violations in 14 areas: 1) Board president exceeding his authority, 2) Elections, 3) Terms of office, 4) Open meetings requirements, 5) Calling meetings of a governing body, 6) Email, phone, private conversation or other means of voting outside of open meetings, 7) Removing directors, 8.) Record-keeping, 9) A petition to audit records, 10) Arbitrary and capricious covenants enforcement, 11) Unauthorized expenditures of Association monies; 12) Rules and regulations, 13) Failure to fulfill fiduciary duties and 14) Acts of Comanco that violate our governing laws.

The Amended Complaint for Injunctive Relief adds additional charges that include: 1) Breach of fiduciary duty, 2) Fraud in the concealment and/or omission, 3) constructive fraud, 4) Civil conspiracy, 5) aiding and abetting, 6) Theft by unauthorized control over property and by deception, 7) Embezzlement – Fraudulent misappropriation by fiduciaries, 8.) Fraudulent misrepresentation by corporate officer or agent, 9) Defamation by libel and slander.
